Abu Dhabi Property Tax Guide for Foreign Buyers

“Tax-free property” is too broad to be a useful buying assumption. A foreign buyer considering The Canopies at Yas Point should separate the VAT treatment of a new residential unit, transaction and registration costs, recurring community charges and the buyer’s own tax position.

1. Residential VAT is not the same as every other cost

The Federal Tax Authority’s real-estate guide states that the first supply of a newly completed residential building within three years of completion is zero-rated for UAE VAT. Later sales or leases of residential buildings are generally exempt. These rules concern the supply of the residence itself; they do not make every service linked to the purchase VAT-free.

The Canopies is an off-plan residential development with estimated completion in Q3 2030. Buyers should use the developer’s current reservation form, Sale and Purchase Agreement and payment requests to confirm how each amount is treated for their exact unit.

2. Confirm transaction and registration costs in writing

An off-plan purchase can involve registration, administration, financing, valuation or bank-related costs in addition to the purchase price. The responsible authority, timing and allocation can depend on the transaction and the contract. Ask for a current itemised cost sheet rather than relying on an old percentage from an advertisement.

ADREC publishes the governing registration rules and service channels. Before reservation, identify which costs form part of the price, which are payable separately, whether any amount is refundable and which party receives it.

3. Community service charges have their own VAT treatment

The FTA guide explains that charges for maintaining and operating communal areas are services and are subject to VAT at the standard rate. They are distinct from the sale or lease of the residential unit.

Future service charges for The Canopies should not be guessed before an official budget or disclosure is available. Request the applicable estimate and its basis when the developer releases it, then allow for VAT and future changes in an ownership budget.

4. Individual income tax and corporate tax are different questions

The UAE Government states that the UAE does not levy income tax on individuals. The Ministry of Finance also explains that personal real-estate investment income of a natural person, when it is not conducted through or required to be conducted through a licence, is outside the scope of UAE Corporate Tax.

That does not determine tax residence or reporting obligations in another country, and it does not automatically apply to companies, licensed businesses or every ownership structure. Cross-border buyers should obtain advice covering their residence, ownership vehicle, rental plans and eventual disposal.

5. Build a complete ownership budget

Start with the verified unit price and 55/45 payment schedule, then add every disclosed transaction cost, financing expense, insurance item, service charge and VAT-bearing service. Keep a separate contingency for changes that are permitted under the contract.
